DISCLAIMER: Our photographers provide a camera preview of the RAW images to the agent prior to leaving the site to ensure the agent is satisfied with the compositions and to prevent reshoots.  Additional visits and/or reshoots based on additional requests will result in additional costs.  Please provide all expectations prior to the listing shoot to help us prepare.  Services performed are solely within the property/address plot limits.  Additional requests & services that require offsite visits will result to additional costs.

Photography Licensing Agreement

This Photography Licensing Agreement (the "Agreement") is entered into by and between Everything Real Estate Media ("Licensor") and [Real Estate Agent/Client Name] ("Licensee") collectively referred to as the "Parties."

1. Grant of License:
Licensor grants Licensee a non-exclusive, non-transferable license to use the photographs (the "Photography") provided by Licensor solely for the purpose of marketing the specified property. This license is limited to the duration of the property's marketing period.

2. Ownership and Restrictions:
a. All rights to the Photography, including but not limited to copyrights, remain the exclusive property of Everything Real Estate Media.
b. Licensee acknowledges and agrees that the Photography is licensed, not sold, and that no ownership or intellectual property rights are transferred to Licensee.
c. Licensee shall not alter, edit, or modify the Photography without prior written consent from Licensor.

3. Prohibited Uses:
a. The Photography shall not be sold, sublicensed, or redistributed to third parties for commercial use without the express written consent of Everything Real Estate Media.
b. Licensee shall not use the Photography for any purpose other than marketing the specified property without prior written approval from Licensor.

4. Confidentiality:
Licensee agrees to keep confidential any information provided by Licensor, including but not limited to the terms of this Agreement.

5. Compensation:
The Licensee agrees to pay the agreed-upon licensing fee as outlined in the separate agreement/invoice between the Parties.  All pricing can be found on EverythingREM.com or will be emailed separately for specialized projects.

6. Termination:
Licensor reserves the right to terminate this license at any time for a material breach of the terms contained herein. Upon termination, Licensee shall cease using the Photography and return or destroy all copies in their possession.

7. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising out of or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the [Arbitration Association].

IN WITNESS WHEREOF, the Parties hereto have executed this Photography Licensing Agreement as of the Effective Date.
